What are your thoughts regarding caps on malpractice awards? California currently has a $250,000 cap for non-economic damages in medical malpractice lawsuits. Caps were first put in place in California in 1975, and many states followed suit with caps; however, the tables have turned, and now California ranks at the low end of the 35 states with caps (Lazo, 2014)

What are your thoughts regarding caps on malpractice awards? California currently has a $250,000 cap for non-economic damages in medical malpractice lawsuits. Caps were first put in place in California in 1975, and many states followed suit with caps; however, the tables have turned, and now California ranks at the low end of the 35 states with caps (Lazo, 2014). In fact, California recently voted down a proposal to raise medical malpractice caps (Laso, 2014). Removing or increasing caps will likely increase medical malpractice insurance costs; therefore, passing these costs on to the patient. However, what if something serious happened to either this baby or mother? Do you think that the $250,000 is a fair amount for this case?
